What Is OneCallClaims?

OneCallClaims is an independent claim management service. We help not-at-fault drivers recover costs from the at-fault party (or their insurer) following a motor vehicle accident.

We are NOT:

  • • An insurance company
  • • A law firm or legal practice
  • • A substitute for your own insurance
  • • A personal injury specialist

How We Get Paid

For eligible not-at-fault claims, we typically recover our costs from the at-fault party\'s insurer as part of the claim. This means:

  • If the claim is successful and the at-fault insurer pays, you generally don\'t pay us directly.
  • If the claim is partially successful, the outcome depends on what the at-fault insurer agrees to pay.
  • If the claim is unsuccessful (for example, if liability is denied), recovery is not guaranteed, and alternative arrangements may apply.

We will always explain the specific arrangements for your case before you proceed. We won\'t surprise you with hidden fees.

Replacement Vehicle Arrangements

If you need a replacement vehicle, there are different ways this can be arranged:

Option A: Insurer-Approved Replacement

If the at-fault insurer accepts liability quickly, they may directly arrange and pay for a rental vehicle. This is the simplest scenario.

Option B: Credit Hire Arrangement

If immediate approval isn\'t available, you may be offered a vehicle on a "credit hire" basis. This means:

  • You receive a vehicle without upfront payment
  • The hire company pursues recovery from the at-fault insurer
  • You will sign a hire agreement with specific terms and conditions
  • If recovery from the at-fault party fails or is only partial, you may be liable for some costs

Important: Before signing any hire agreement, make sure you understand:

  • • What the daily hire rate is
  • • What happens if the at-fault insurer doesn\'t pay
  • • Your obligations under the agreement
  • • How long you can keep the vehicle

We will explain these terms clearly. If you\'re unsure, don\'t sign until you understand.

What We May Need From You

To pursue your claim effectively, we may need you to:

  • Provide accurate information about the accident and the parties involved
  • Supply evidence such as photos, dashcam footage, and witness details
  • Provide a statement describing what happened (we\'ll help you prepare this)
  • Respond to requests for additional information in a timely manner
  • Cooperate with the process, which may include attending your vehicle for assessment

Risks You Should Understand

Recovery Is Not Guaranteed

While we work hard to recover costs for our clients, success depends on factors outside our control:

  • • The at-fault insurer may dispute liability
  • • Evidence may not clearly support your position
  • • The other driver may be uninsured
  • • Costs claimed may be challenged as unreasonable

If liability is seriously disputed or the claim cannot be resolved through negotiation, legal action may be required. We don\'t provide legal services—if this situation arises, you may need to engage a lawyer.

What Happens If Liability Is Disputed?

If the at-fault insurer denies liability or disputes fault:

  1. We will present the evidence supporting your position
  2. We may request internal review by the insurer
  3. If the dispute cannot be resolved, we will advise you of your options, which may include:
    • Claiming on your own insurance (if you have comprehensive cover)
    • Seeking independent legal advice
    • Accepting a partial settlement (if offered)

We will keep you informed throughout and won\'t leave you in the dark about what\'s happening with your claim.
